1. Parties and Acceptance

These Terms of Service ("Terms") form a legally binding agreement between you ("User", "you") and Xblanc Sp. z o.o., a Polish limited liability company registered under KRS 0001206396, with its registered office at ul. Henryka Sienkiewicza 22, 60-818 Poznań, Poland, NIP: 7812100149, REGON: 543298631 ("GliminTor", "we", "us"). By creating an account, activating a trial, or subscribing to any plan, you confirm you have read, understood, and agree to be bound by these Terms and all policies referenced herein. If you do not agree, do not use the platform. If you act on behalf of a company or entity, you represent that you have authority to bind that entity.

2. The Service

GliminTor OS is a cloud-based content operating system providing social media scheduling and publishing, unified inbox management, AI-powered content generation, media production, analytics, Outreach messaging, live streaming, contact management, and related features ("Service"). The Service is accessed via glimintor.com and app.glimintor.com. Features, limits, and Ops Credits allocations vary by plan tier. Current plan features and pricing are shown at checkout and on the pricing page at glimintor.com/pricing. We reserve the right to modify, suspend, or discontinue any feature or aspect of the Service with reasonable advance notice of material changes. AI-generated outputs — including captions, scripts, images, videos, and analysis — may contain errors, inaccuracies, or omissions. You are responsible for reviewing all AI-generated content before publication or use. GliminTor does not warrant the accuracy, completeness, or fitness for purpose of AI-generated outputs. Connected third-party platform access depends on the availability and policies of those platforms. We are not responsible for changes, restrictions, or outages in third-party APIs.

3. Account Eligibility and Security

You must be at least 18 years of age to register. By creating an account you represent that you meet this requirement. You must provide accurate, current, and complete registration information and keep it updated. You are responsible for all activity under your account. Notify us immediately at [email protected] if you suspect unauthorised access. We reserve the right to suspend or terminate accounts where we reasonably suspect fraud, security compromise, or breach of these Terms.

4. Subscriptions, Plans, and Pricing

## 4.1 Plan Tiers The Service is offered on named plan tiers. Each tier provides access to defined features, a set number of seats, connected profiles, workspaces, and a monthly allocation of Ops Credits. Features and limits vary by tier. Current details are published at glimintor.com/pricing. ## 4.2 Ops Credits Ops Credits are the metered unit governing AI-powered features. Credits are consumed only when AI functionality is actively invoked. Scheduling, publishing, calendar management, inbox browsing, analytics viewing, and other platform operations do not consume Credits. Monthly Credits are allocated at the start of each billing cycle and expire at cycle end — unused Credits do not roll over. Boost Pack Credits purchased separately expire 90 days from purchase. Credits have no monetary value and cannot be redeemed for cash. ## 4.3 Pricing and Payment Current prices are shown at checkout and at glimintor.com/pricing. Subscriptions are billed in Euro (EUR) in advance on a monthly or annual basis. Annual subscriptions are billed at ten times the monthly price, providing two months of access at no additional charge. Payment is processed by Stripe, Inc. By subscribing you authorise recurring charges to your payment method. Amounts are exclusive of applicable taxes. ## 4.4 Price Changes We may modify pricing with thirty (30) days advance notice by email and in-platform notification. Continued use after the effective date constitutes acceptance of updated pricing. ## 4.5 Failed Payments If payment fails we will retry. If payment remains outstanding after reasonable retry attempts we may restrict AI feature access. If unresolved within 14 days we may suspend the account. Outstanding balances remain due.

5. Trial

We offer a 7-day free trial of the Service. During the trial period zero Ops Credits are provided. AI features are visible but require a paid credit allocation to run. You may connect your social and inbox accounts and access your performance data during the trial. A valid payment card is required at the start of the trial for identity verification. No charge is made automatically at the end of the trial period. You must actively select a plan and confirm payment to be charged. The trial may not be offered to users who have previously held a paid subscription.

6. Cancellation and Termination

## 6.1 Cancellation by You You may cancel at any time via Settings → Billing within the platform. Cancellation stops future billing immediately. Access to the Service continues until the end of the current paid period. ## 6.2 Refunds Subscription fees, Boost Pack purchases, and add-on fees are non-refundable once access has been granted and credits or services have been made available, subject always to mandatory rights under applicable law. For EU/EEA consumers, the applicable withdrawal right treatment and the conditions that govern it are described in the Billing and Refund Policy. ## 6.3 Termination by GliminTor We may suspend or terminate your account immediately without notice if you breach these Terms or our Acceptable Use Policy, engage in fraudulent activity, fail to pay amounts due, or if required by applicable law. Upon termination access ceases. Your data is retained and deleted per the Privacy Policy.

7. Intellectual Property

## 7.1 Our Rights GliminTor OS, including all software, design, trademarks, logos, and underlying technology, is owned by Xblanc Sp. z o.o. or its licensors. Nothing in these Terms grants you any right in the platform beyond the limited licence to use the Service during your active subscription. ## 7.2 Your Content You retain ownership of content you create, upload, or publish through the Service. You grant us a limited, non-exclusive, royalty-free licence to process, store, and transmit your content solely to provide the Service. We do not use your content or brand data to train AI models. ## 7.3 AI-Generated Outputs Content generated by AI features using your inputs is owned by you, subject to any terms of the underlying model providers. You are responsible for ensuring AI-generated content complies with applicable law and platform policies before use or publication.

8. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with our Acceptable Use Policy, available at glimintor.com/legal/aup and incorporated into these Terms by reference.

9. Third-Party Platforms and Integrations

The Service connects to third-party platforms including social networks, messaging services, and CRM tools. Your use of those connections is governed by the respective third-party terms. We are not responsible for the availability, accuracy, or conduct of third-party services. By connecting a third-party account you authorise us to access and interact with it as necessary to provide the features you use.

10. Data Protection

We process personal data in accordance with our Privacy Policy at glimintor.com/legal/privacy and applicable data protection law including the GDPR. Where you act as a data controller and we act as processor, the Data Processing Agreement at glimintor.com/legal/dpa governs our processing activities.

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components. We do not warrant the accuracy or fitness for purpose of AI-generated outputs.

12. Limitation of Liability

To the maximum extent permitted by applicable law, GliminTor and Xblanc Sp. z o.o. are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service. Our total aggregate liability for any claims under these Terms shall not exceed the total fees paid by you in the twelve months preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot be excluded by law, including liability for death or personal injury caused by negligence, fraud, or mandatory consumer protection rights under Polish or EU law.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Poland without regard to its conflict of law rules. Any dispute arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts in Poznań, Poland. For EU/EEA consumers, nothing in this clause limits your right to bring claims in the courts of your country of habitual residence or to rely on mandatory consumer protection provisions applicable in your jurisdiction. For users in the United States, United Arab Emirates, Kingdom of Saudi Arabia, and Egypt, you retain any mandatory consumer rights that apply under the laws of your jurisdiction that cannot be waived by contract. In the event of conflict between these Terms and mandatory local law, mandatory local law prevails to the extent required.

14. Changes to These Terms

We may update these Terms. Material changes will be notified by email and in-platform notification at least thirty (30) days before taking effect. Continued use after the effective date constitutes acceptance.

15. General

If any provision of these Terms is found unenforceable, the remaining provisions continue in full force. Our failure to enforce any right is not a waiver. These Terms, together with the Privacy Policy, Acceptable Use Policy, and Billing and Refund Policy, constitute the entire agreement between you and GliminTor regarding the Service.
